The rental market in Spain, along with rental regulations, has undergone several changes to streamline the rental process and establish clear rules for renting. In May 2023, Law 12/2023 of May 24, on the Right to Housing was definitively approved—the first of its kind since the adoption of the Spanish Constitution. The law came into effect on May 26, 2023, and introduces a series of changes that impact both tenants and property owners.

In Spain, there are different types of housing rental contracts depending on the purpose of the rental. The main types include:

  1. Long-Term Rental (Vivienda Habitual) – Designed to meet the tenant’s permanent housing needs. Contracts last a minimum of 5 years (7 if the landlord is a legal entity) and are automatically renewable.
  2. Temporary or Seasonal Rental – Intended for professional, work-related, study, or medical reasons, generally lasting less than a year. The reason for temporariness must be justified in the contract.
  3. Room Rental – Covers the use of part of a property. Specific regulations apply, especially in areas with high housing demand, to ensure the rent is not higher than the full property.
  4. Tourist Rental – For recreational, vacation, or short-stay purposes. Regulated by the local tourism authority and the Civil Code, with strict licensing requirements.
  5. Non-Residential Use Rental – Includes commercial premises, offices, or professional workspaces. The terms are primarily determined by the agreement between the parties.
